Briefly describe the advantages of parties reaching an agreement and entering into a separation agreement.

What will be an ideal response?


A successfully negotiated separation agreement reflects the best efforts of both parties and their respective attorneys. Parties should encourage agreements. Separation agreements are faster and more economical. Parties are not usually subjected to the adversarial system. They have some input regarding the resolution of issues of the divorce rather than relying on the court. Parties are forced to compromise, which requires the meeting of the minds. The degree of noncompliance is relatively high, but even the best drafted and negotiated agreements may still result in noncompliance. 
With the increase in the use of collaborative divorce, more couples come to an agreement before the expensive litigation stage is reached.
