The theories are similar in that both see laws as necessary to an orderly society; they are different in how they view the purpose of punishment. Consensus theory is more humanitarian, seeing punishment as revenge and as a way to restore social order. Conflict theory views punishment as a way to control the lower class and to preserve the power of the upper class.
