The defense attorney is the counterpart of the prosecuting attorney in the criminal process. As an attorney, the defense counsel is obligated to uphold the integrity of the legal profession. The accused may obtain counsel from the private bar, or if the defendant is indigent or cannot pay, private counsel or a public defender may be assigned by the court.
