Because the core of the Fifth Amendment provides protection against the use of un-Mirandized, coerced statements only at trial, and because Martinez was never prosecuted, no violation of the Fifth Amendment occurred. Further, the police officer's conduct did not rise to the level of that which would so "shock the conscience" as to violate a liberty interest protected by the due process clause of the Fourteenth Amendment. Because no constitutional violation occurred, the officer had qualified immunity.
