Explain what an officer should do to prepare for presenting the case to the prosecutor
What will be an ideal response?
Prior to taking the case file to the prosecutor, the investigating officer should review the case and determine its strengths and weaknesses. The officer should check to see what evidence has been retained in the evidence locker. If any test results are available, they should be reviewed. The officer should also review the statements made by the witnesses in the case and consider how the defense is likely to try to impeach each witness.
The officer needs to review all of these things as objectively as possible. It will help to think about problems facing the prosecutor. It is also important to go over the possible crimes that the prosecutor may want to file and the sentences that a judge is likely to give based on the facts of the case. After reviewing all of these things, the investigating officer should develop arguments in support of the charge he/she feels is most appropriate.
