Students might argue many angles in response to this question, but one possible response is to advocate the widespread adoption of presumptive sentencing guidelines. One could argue such a scheme is a way to allow fair sentencing practices, but also to still provide judges with flexibility. There will always be difficult and outlier cases, but these practices are probably the fairest the majority of the time.
