Any proposed constitutional amendment requires a two-thirds vote of approval by the House and the Senate. Once the proposed amendment clears Congress, it must then be ratified by at least 38 states to become a constitutional Amendment. There are many possible flaws in the system, though it is fairly balanced, in that the deliberative bodies of Congress must debate any proposed changes, which then are reviewed by the states. The student may have some interesting adjustments, and the grade should reflect the flaw that has been identified and the effectiveness of the student's proposed change in addressing the flaw.
