How is the claim of privilege made? What is a consequence of failing to make a claim of privilege?

What will be an ideal response?

The client has the burden of proving that the privilege exists. In order for a communication to be protected, the privilege must be asserted and its existence established by the client. If none is made, the privilege may not be asserted, and the protection afforded by the privilege may be waived.
