If the value of the home falls below the unpaid balance owed on the home mortgage, the homeowner can simply stop making monthly mortgage payments. The lender can foreclose and repossess the property, but cannot hold the former homeowner accountable for the balance of the mortgage that remains unpaid and unsatisfied. Anti-deficiency laws were adopted to protect
homeowners during the Great Depression when home values throughout the country were very depressed. It should be noted that state anti-deficiency laws are not binding on federally insured (FHA) loans.
