However, the Supreme Court ruled in Ashcroft v. Free Speech Coalition (2002) that the portion of the CPPA prohibiting the production or distribution of such virtual pornography was overly broad and an unconstitutional infringement on the First Amendment right to freedom of speech. In effect, it's not illegal in the United States.
