If the guidelines end and the combined incomes exceed the upper limit, the court can order support in a greater amount. Also, if the payor is responsible for excessive travel expenses for visitation or costs for health care, tuition, special needs care, or is under a prior court support order, a downward deviation can be ordered. If the parents have the children for equal amounts of time, and the “residential parent” is not the primary custodial parent, the court can reduce support. It will always make this deviation in the best interest of the child.
