Students may include any of the following in their answer. Most people do not understand what is required to properly execute a will. Most people don’t just have probate assets, or don’t know how to properly disperse all their different types of assets. Lay people may fail to address second marriages, and may consequently leave everything to “their space”. Lay people may not appropriate for their children correctly. Many people also assume, that the value of their assets is much lower than they really are valued at, or may not include all of their assets. If a person owns their own business, this will complicate their will, and most do not know how to correctly show this in their will. Although some people will use online will programs, these programs often do not account for the specifics of that individual or the state statues. As a consequence, if a will is done by a lay person, the will may not be valid, and the beneficiaries may have to go to probate court to settle the matter.
