Example should indicate that prior to the 1970s, intermediate sentences were used and judges had discretion to individualize sentences to the offender and the offense. An unintended consequence of this was inequity in sentencing; two people who committed the same crime could receive very different sentences. There was a shift to structured sentencing which gave fixed terms and greatly reduced judicial discretion.
