States need to adopt new laws to address sexting by minors because otherwise a minor convicted on child pornography charges for engaging in sexting is guilty of a felony, can serve 5 years in prison for a single count of transmitting or possessing child pornography, and must register as a sex offender, a stigma that will haunt him or her for life. In brief, the application of general child pornography laws to minors who sext seems far too harsh, especially when the sexting was consensual and confined between two willing minors. Most of the new legislation, thus, either reduces consensual sexting committed by minors of a certain age to only a misdemeanor offense, rather than a felony, or treats it (at least on the first occasion for a minor) as a noncriminal offense subject only to monetary fines and/or community service obligations.
