The Adoption and Safe Families Act was a response to AACWA, as there were concerns that family preservation efforts were excessive and too many resources were being expended on foster care. The law declared that the “child’s health and safety shall be the paramount concern,” the law eliminated the federal requirement of reasonable efforts in serious cases, the law invited states to develop a list of aggravated circumstances that would excuse the agency from the reasonable efforts requirement. Additionally, it increased the frequency of review hearings and said that a permanency planning hearing should be held once a child has been in foster care no more than 12 months.
