Discuss the situations when the protections afforded by the Fifth Amendment does not protect against self-incrimination
What will be an ideal response?
Self-incrimination protection applies only to evidence that is communicated or testimonial in nature. It does not apply to statements that might incriminate a third party or to physical evidence. Self-incrimination does not apply to corporations, businesses, labor unions, and other organizations. Additionally, self-incrimination does not apply in noncriminal cases in which a state's public interest is unrelated to the enforcement of its criminal laws.
