Distinguish between an administrative agency's interpretive and procedural rules
Interpretive rules are statements and opinions issued by an administrative agency explaining how it interprets and intends to apply the law it enforces. Such interpretive rules do not have the force of law. They are not automatically binding on private individuals or organizations. Likewise, they are not binding on the courts, as are statutes and regulations. An agency's interpretive rule can be challenged in court, if it is believed to be incorrect. In practice, however, the courts give considerable weight to the interpretative rules when deciding cases involving other agency regulations. Procedural rules describe an agency's methods of operation and establish procedures for dealing with the agency. These rules cover hearings, negotiations, settlements, presentations of evidence, and other activities.
