Compare and contrast the attorney-client privilege with the physician-patient privilege

What will be an ideal response?


Both the attorney-client privilege and physician-patient privilege are based on the need for open communications if the professional relationship is to achieve its intended purpose. Both include office staff as necessary partners to providing the services sought. Both privileges give the client the benefit of the doubt if it turns out that the professional person is not licensed to practice in the state. The client holds both privileges and the attorney or doctor is required to invoke the privilege unless explicitly told not to do so. The main exception to the attorney client privilege is it cannot be claimed if the attorney's services were sought to help a person commit a crime or escape punishment. On the other hand, many states do not recognize the physician-patient privilege at all in criminal court. There are many laws mandating that physicians make reports to the government (example: child abuse, gunshot injuries, etc.) but very few requiring attorneys to report on their clients.
