An ancillary administration is required when a decedent lived in one jurisdiction, but has real property in another jurisdiction at the time of death. Probate proceedings are needed in the location where the real property exists. This secondary jurisdiction, does not try to distribute all of the decedent’s property, but rather to determine the proper distribution of this real property. The court with the ancillary jurisdiction will require exemplified or authenticated copies of the original probate procedures documents. The ancillary court will transfer the title of the real property to the correct beneficiary.
