It is important to remember the aid from VWAP is not a victim's right. In this sense, denying services to a victim would be unethical, but not illegal. Witnesses for the defense should ethically have similar services, especially in light of the constitutional mandate that all defendants are innocent until proven guilty. There is concern victim testimony might be coached or rehearsed with VWAP advocates. Changes in testimony can undermine the prosecutor's case and may violate the constitutional right to defend against charges.
