When a principal instructs her agent to commit a crime, the agent is under no legal obligation to do so. In fact, an agent who commits a criminal act under instruction from her principal is guilty of that crime. Originally, it was extremely difficult to convict a principal for the crimes committed by her agent. This was because the commission of a crime normally fell outside of the scope of employment unless the agent received specific orders to violate the law. Today, however, revised criminal codes have made it much easier to impose criminal liability on principals. As with tort cases, the courts look to see if the agent's criminal behavior occurred within the scope of employment.
