Tort actions are difficult to win because the police possess the defense of official immunity. This provides that a law enforcement official is not liable for his or her tortious acts unless there is a demonstration that the officer committed the tort in a “willful or malicious fashion.” This requires proof by a preponderance of the evidence (51 percent) that the officer acted purposely or with disregard for the risk of harm to the plaintiff.
