Explain how the Sixth Amendment's right to counsel applies in the identification context

After an indictment has been filed, the Sixth Amendment right to counsel applies to the witness identification process. In United States v. Wade, 388 U.S. 218 (1967), a defendant was placed in a police lineup, without his attorney present, after he had been indicted for a crime. The Supreme Court held that this violated the Sixth Amendment because a post-indictment lineup is a "critical stage" in the criminal process. Further, "the presence of counsel [at post-indictment lineups] is necessary to preserve the defendant's basic right to a fair trial."
