Explain jury nullification and discuss what happens to a defendant that has been acquitted by jury nullification.
What will be an ideal response?
Example should explain that nullification occurs when a jury votes to acquit a defendant that they believe is factually guilty. This may be due to a belief that the law is unjust or that the government overreached or applied the law in a discriminatory manner. If a defendant is acquitted, they cannot be tried again for the same charge even with new evidence, because of the Fifth Amendment prohibition against double jeopardy.
