Up until the time of Commonwealth vs. Hunt (1842), unions were treated as conspiratorial organizations with the intent to harm free market competition. As a criminal offense, conspiracy was prosecuted by a jury - at the time typically made up of employers and merchants, rather than workers. Commonwealth vs. Hunt (1842), decided by the Supreme Court of Massachusetts, declared that while unions may sometimes engage in conspiratorial activities, unions themselves were not necessarily conspiracies. Thus, one could not assume that all unions were conspiracies; rather, they should be judged on the basis of their actions, not their mere existence. In other words, it was the first major court case to declare that unions were not, per se, illegal institutions.
