Up until the time of Commonwealth vs. Hunt (1842), unions were treated as conspiratorial organizations with the intent to harm free market competition. As a criminal offense, conspiracy was prosecuted by a jury - at the time typically made up of employers and merchants, rather than workers. Commonwealth vs. Hunt (1842), decided by the Supreme Court of Massachusetts, declared that while unions may sometimes engage in conspiratorial activities, unions themselves were not necessarily conspiracies.
