Congress found success in passing the Civil Rights Act of 1964, legislation that banned racial discrimination in places of public accommodation and prohibited employment discrimination based on race, sex, religion, color, or national origin. Congress based this legislation, in part, on the interstate Commerce Clause of Article I, Section 8. In Heart of Atlanta Motel, Inc. v. United States (1964 ) and Katzenbach v. McClung (1964 ), the Supreme Court upheld this law, finding that, because discrimination in employment and places of public accommodation affects inter-state commerce, Congress has the power to regulate it under Article I of the Constitution.
