Structured sentencing is a way of addressing disparities in the sentencing process. Structured sentencing provides judicial guidance and accountability according to severity and prior criminal record, with the goal of consistency throughout the court system of a state. In many structured sentencing states, judges are obligated to use presumptive sentencing for which they may not deviate from a narrow sentence range without providing written reasons as to why they have chosen to do so. This includes not only prison terms, but also directives on whether a particular offense is eligible for probation, and if so, the maximum probationary term. Nearly half of all states cap the probation term at five years, but these terms can range between 3 and 10 years. A dozen or more states now allow earned discharge credits as a way to shorten one's term on probation through good behavior (National Conference of State Legislatures, 2015).
