John is attending a college football game. He is rooting for his university which is the visiting team. Anthony is actively rooting for the home team. John gets upset and throws a bag of popcorn at Anthony

Anthony then hits John breaking his nose and knocking out two of John's teeth. Anthony is tried in state criminal court for battery. He justifies his action as self-defense based on the fact that John hit him first with the bag of popcorn. As the prosecutor, how would you rebut the self-defense claim?

Self-defense contains the components of "proportionality." Proportionality requires that the force used must not be out of proportion to the force necessary to protect. A person is not privileged to use force that is disproportional to the threat that the actor reasonably believes that he is facing.
