A no contest plea is sometimes referred to as a plea of nolo contendere-Latin for "I will not contest it." A nolo contendere plea is not an express admission of guilt by a defendant. Rather, it serves "as a consent by the defendant that he may be punished as if he were guilty and a prayer for leniency" (North Carolina v. Alford, 1970, p. 35 n.8). Although a plea of nolo contendere has the same results in criminal proceedings as a plea of guilty, it cannot be used in a subsequent civil proceeding as a defendant's admission of guilt. Thus, this plea is usually entered when civil proceedings and liabilities may result.
