Some courts created a legal fiction called the family-purpose doctrine. Under this doctrine the assumption is made that the driver is carrying out a "family purpose," making the family head, typically the most financially responsible person in the family, vicariously liable. This doctrine is maintained even though, typically, the driver is using the vehicle on his or her own behalf. So long as the driver is a member of the family's household and has permission to use the car, the head of the family is vicariously liable for the driver's negligent acts.
