• In Fernandez v. United States (1991),the Supreme Court established that medical care in prisons must be "reasonably commensurate with modern medical science and of a quality acceptable within prudent professional standards." This community standards test does not mean that prisons must take every possible step in responding to medical needs, but they cannot deny inmates care that they would have received if not incarcerated. In a prior case the Court also prohibited "deliberate indifference" in responding to inmate medical needs.
