Why have obscenity laws proven to be so problematic? Summarize the principles that have been applied to define obscenity in American history.
What will be an ideal response?
The American legal tradition has been to declare something obscene if it corrupts and depraves the user. Later principles involved the concepts of community standards and prurient interests. Later still, the definition included the lack of literary, artistic, political, or scientific value. The principle of the judgment of a "reasonable" person regarding the lack of social value of a work has also been applied. The problem with these criteria, as well as the earlier standards, is that they are highly subjective.
