The parties had a valid contract, but Jane has breached the contract by failing to provide the goods specified in the contract. This is assuming that the contract clearly stated the breed of dog that was bargained for and given in exchange. Bill can refuse to accept delivery of the nonconforming dog. If he accepts delivery of the nonconforming dog, he can sue for damages. The amount of damages he may have will be based on the value of the dog contracted for and the value of the dog received.
