The victim was the father of the juvenile's friend. The gang member admitted he killed the man in retaliation for grounding his friend after the friend verbally abused his father. The gang member has been properly arrested and booked for the offense. He has no prior criminal history. His demeanor is cocky and savvy. What will happen now? Answers will vary, but students should address the intake process, which will screen the case and probably make a recommendation to the prosecutor to transfer (or certify or waive) this case to the criminal justice system. The boy's age will be weighed against the seriousness of the crime, murder, and possession of a weapon, as well as the boy's gang membership. If convicted, this gang member will likely face the prospects of an institutional program for juveniles extending into adult incarceration, depending on the nature of the jurisdiction of the sentencing judge (exclusive-blend, contiguous-blend, inclusive-blend). Students should address whether any programs in prison would benefit the gang member because of his age.
