The law in the United States historically has criminalized various consensual acts that are considered harmful as well as immoral. Prostitution, for example, involves two mutually consenting adults although it is criminalized in every jurisdiction in the United States outside of Nevada. Crimes like prostitution, gambling, vagrancy, euthanasia, and the possession of obscenity and various types of narcotics are called victimless crimes because there allegedly is no identifiable victim (Schur 1965). A case nonetheless can be made that these acts do harm the individuals involved as well as society. Some commentators contend it is more accurate to view these so-called victimless crimes as consensual crimes or as crimes against public order.
