The legal team is duty bound to honor the duty of confidentiality, which, in Model Rules
jurisdictions, covers all client information, not just client confidences. However, because
lawyers are officers of the court, they—as well as their employees—must honor the legal
system’s requirement of fairness, even to the extent that it appears disadvantageous to the
client’s interests. For example, the discovery rules require the legal team to respond to the
requests of the other party, unless the request concerns privileged information. But, the work
product rule does allow the requesting party to get information that would otherwise be
protected if the requesting party demonstrates substantial need of the information and has no
other way to obtain the substantial equivalent.
