If an agreement is reached between a landlord and a tenant who has breached the lease, what should be included in the stipulation?
What will be an ideal response?
From the landlord’s perspective, the stipulation should include an acknowledgment by the tenant of the amount owed, set out an agreed-upon payment schedule for the back rent, and set forth the payments required to be made in the future until the expiration of the lease. The stipulation should further provide that if all payments are made according to this schedule, the landlord will dismiss the suit. However, if the payments are not made, the tenant agrees that the landlord may proceed with the suit. If state law allows, the stipulation should provide that if the tenant fails to make payment, the tenant waives the right to a court hearing and allows the landlord to proceed to summarily evict and retake possession.
