Unfair labor practices are defined by the Wagner Act as explicitly illegal employer actions in the organizing and collective bargaining process. Under Section 8(a)(1), employers are prohibited from interfering, restraining, or coercing employees who are exercising their unionization and collective bargaining rights. Under Section 8(a)(2), employer-dominated unions are made illegal to ensure employee free choice of representation. The Wagner Act explicitly prohibits employers from discriminating against workers who join or support unions under Section 8(a)(3). Section 8(a)(4) prohibits an employer from retaliating against a union member because they have filed charges against the employer under the Wagner Act. Finally, Section 8(a)(5) makes it illegal for an employer to refuse to recognize a duly elected and certified labor representative of its employees. Employers who are found guilty of these unfair labor practices, can be issued injunctions, required to pay backpay, and reinstate wronged employees.
