Answers may vary but the following are the primary distinctions between the offenses:
• Forgery of a check A forged check bears the maker's signature or endorsement but was signed by someone else not authorized to execute the signature. Check may also bear false information such as bogus account numbers.
• Theft by check This check may bear the true name of maker but is issued by maker with intent to deceive the recipient of the check. Check will be rejected by the bank due to no account or insufficient funds in the account. Key factor is maker's intent to deprive another of property.
• Issuance of a bad check Maker of check signs true name to check on current account but knows he or she does not have sufficient funds in the account to cover the check and all others then outstanding.
