Review the section in the textbook on simultaneous death on page 55. Write a summary of this right and either support this ruling or write what changes you would make to this ruling.
What will be an ideal response?
Simultaneous death requires both parties to die at the same time. This does not occur if the decedent and beneficiary die within a short time of each other. Some states provide a 120 hour grace period to which if both the decedent and beneficiary die it is still considered a simultaneous death. Some students may argue that this is either too much time or too little time to be considered simultaneous. Arguments could be made that wills need to be very specific in regard to time of death and write their own clause to preclude any scenarios and plan ahead for these type of events. While other students may feel that these situations should be addressed in state statues.
