The Fourth Amendment establishes that an individual is to be secure from any unreasonable search or seizure by police. Therefore, evidence obtained in a manner deemed to have violated an individual's Fourth Amendment right is considered inadmissible in a court of law. Hence the term "exclusionary rule" refers to illegally obtained evidence from the crime scene. The exclusionary rule is based upon U.S. Supreme Court precedent in the matter of Weeks v. U.S. (1914). Here the court established that if law enforcement improperly seizes evidence, that evidence cannot be used later in the criminal trial process. More specifically, this rule serves as a guideline for police to obtain search warrants before entering private property during a criminal investigation. The exclusionary rule ensures that the criminal defendant is afforded due process from the onset of a criminal investigation, and that the constitution governs police behavior during the investigative process.
