Allen has left the home and his wife, Sue. The petitioner is home alone with the children, as she is a stay-at-home wife and mother. Their initial court date is nearing. We would ask Sue to provide a detailed log of her current household expenses, as well as an overview of annual ones, such as tuition or property taxes. We would need to see tax forms, insurance forms, pay stubs, and investment and pension information. The first court appearance would require the presentation of the financial statements by both parties, and our request for pendente lite or temporary alimony and child support, so we will need to segregate expenses. The potential payor spouse will receive notice of this request so that he can come before the court to present his side of the case. The child support payments are usually dictated by state guidelines, and the property has not been distributed, so a final alimony award is not possible yet.
