If his case is again affirmed within the U.S. State Supreme Court it is possible he could appeal to the U.S. Supreme Court. If his conviction, instead, occurred within the federal district court his appeal would be heard by the Federal Court of Appeals, which is the federal appellate court. If his case is affirmed within the Federal Court of Appeals, it is possible he could appeal to the U.S. Supreme Court.
