The role of defense counsel is primarily (1) to ensure the defendant’s rights are not violated
(intentionally or in error) by the police; (2) to make sure the defendant knows all his or her options before
the defendant makes a decision; (3) to provide the defendant with the best possible defense, without
violating ethical and legal obligations; (4) to investigate and prepare the defense; and (5) to argue for
lowest possible sentence or best possible plea bargain. Several types of defense counsel include
private, retained counsel, public defenders, and appointed counsel. Retained counsels are attorneys
selected and paid by the defendant. Public defenders are hired by the state but work for defendants who
cannot afford to hire their own lawyer. Appointed counsels are private attorneys who are paid by the
state on a case-by-case basis to represent indigent defendants.
