When a police officer places someone under arrest without just cause, this abuse of police authority violates an individual's rights to personal freedom. Consequently, the police department might find itself a codefendant in a civil lawsuit involving the false arrest. Another situation involves a police officer involved in a high-speed pursuit of a suspect. This situation creates a heightened potential for injury to unsuspecting motorists on the highway. Should an innocent bystander or another driver be struck by a police vehicle, the police department could be held liable for negligent actions by the officer. Law enforcement supervisors can be sued for the personal behavior of their officers as well as overzealous actions by patrol officers. For example, if it can be demonstrated that a police department hired an officer with existing mental problems, who used excessive force, a civil lawsuit could be filed against police supervisors for negligence.
