Communications professor Sut Jhally has been threatened with a lawsuit by MTV for
compiling excerpts of MTV programming into a non-profit educational video called
"Dreamworlds: Desire/Sex/Power in Rock Video." According to MTV lawyers,
"Dreamworlds" violates the "fair use" doctrine for copyrighted materials just as xeroxing
books for educational use is a violation.
What will be an ideal response?
Argument from analogy. The analogy is not a good one. Xeroxing books for
classroom use competes with material that would otherwise be purchased; Jhally's
videotape does not. MTV does not sell its programs.)
