The complaint begins with the caption, naming the court in which the case will be heard, the case number, and the parties involved. The case number will be assigned by the clerk of court when the complaint is filed at the courthouse. Following the caption is the pleading designation, indicating that the pleading is a complaint for tenant eviction. The body of the complaint may include one or more counts. The removal of the tenant from the leased premises and the retaking of the premises by the landlord is one count. If the landlord is also asking for back rent, this would be an additional count in the complaint. If the landlord is evicting a holdover tenant, the first count of the complaint would be for the eviction of the tenant and the second count would be for money damages for the holdover period. A copy of any notices delivered to the tenant and a copy of the lease agreement should be attached as exhibits to the complaint. In closing, the complaint must include a prayer for relief that tells the court the relief requested by the landlord/plaintiff.
