Miranda is required when two circumstances exist. One, the person must be in custody. Two, the person must be being interrogated. Miranda is not necessary in noncustodial interrogations or prior to interrogations of the defendant in custody. The original purpose of the Miranda was to prevent coercive statements and to eliminate confessions obtained through torture. An interrogation must cease once the defendant expresses his/her right to remain silence and a request for an attorney is made. This request can be made at any point, but any information provided prior to that point is still valid. Miranda does not attach during routine traffic stops, during Terry stops, when voluntary statements are made, during noncustodial situations, during routine booking questions, questioning by non-law-enforcement personnel, or from information gathered by undercover operatives.
