Answer should indicate that in this landmark case, Ernesto Miranda was not informed of his Fifth Amendment right against self-incrimination and his Sixth Amendment right guaranteeing an attorney. A person cannot assert rights that they do not know that they have. As a result of this case, a suspect must be informed prior to questioning that they have the right to remain silent, that anything they say will be used against them in court, that they have a right to an attorney, and that an attorney will be appointed if they cannot afford one.
