The statute 42, U.S. Code Section 1983 provides civil rights protection to all persons protected under the act, when a defendant acts "under color of law" (misuses power of office). It is also meant to provide an avenue to the federal courts for relief of alleged civil rights violations. Several factors have contributed to a surge in Section 1983 actions. First, some lawyers believe that a better caliber of judges and juries can be found in the federal forum. Federal judges, who are appointed for life, can be less concerned about the political ramifications of their decisions than the locally elected judges. Furthermore, federal rules of pleading and evidence are uniform, and federal procedures of discovery are more liberal.
